The LOC was challenged and finally the LOC was quashed the Hon’ble High Court at Calcutta. Financial Institutions cannot use Look Out Circular for recovery of loans. -
Directorate of Enforcement and another Vs Union of India and OthersDirectorate of Enforcement and another Vs Union of India and Othersthe ED had appealed an order of the Hon’ble Single Bench of the Calcutta High Court before the Division Bench presided by the Hon’ble Chief Justice. The Hon’ble Single Judge had allowed the petitioner’s prayer for setting aside the Provisional Attachment Order since 180 days had passed with all consequential benefits. The Hon’ble Division Bench in the appeal overturned the part where all consequential benefits were given but upheld the setting aside of the Provisional Attachment Order. A Provisional Attachment order issued by ED has to be confirmed by the Adjudicating Authority (PMLA) within 180 days of the issuance of the Provisional Attachment order otherwise it lapses. -
Central Bank of India and Others Vs The State of West Bengal and Others along with Central Bank of India and Others Vs Ku Chih Choi and OthersCentral Bank of India and Others Vs The State of West Bengal and Others along with Central Bank of India and Others Vs Ku Chih Choi and OthersIn this matter the Central Bank of India had auctioned a property and misrepresented that the said property was free from all encumbrances. The writ petitioner had believed The Central Bank of India and purchased such auctioned property. However The Central Bank Of India failed to give possession to the petitioner. in such circumstances, the writ petitioner had filed the instant writ petition before The Hon'ble Single Judge of the Calcutta High Court. The Hon'ble Single Judge directed The Central Bank of India to return the sale amount along with interest to the writ petitioner. Against such order the Central Bank of India came up in appeal before The Hon'ble Division Bench presided by the Hon'ble Chief Justice. The Hon'ble Division Bench dismissed the said appeal. If an auction notice does not contain all the details fully and completely then there is gross misrepresentation by the bank and therefore purchaser is entitled to get the sale amount back from the bank if the bank is unable to handover possession of the property. -
The Kaviraj Atul Behari Dutt Trust Estate and Others Vs. South Dumdum Municipality and OthersThe Kaviraj Atul Behari Dutt Trust Estate and Others Vs. South Dumdum Municipality and OthersIn this matter, the south dumdum municipality had installed light posts on the private land of the petitioners which houses a non-profit charitable mental hospital and also installed a transformer on the gate of the trust property. Against such arbitrary action, writ petition was filed and the Hon’ble Court directed the Municipality to remove everything.

2. Appeared pro bono for a retied school teacher who could afford legal costs of a civil revision.
